Fair Use Policy

This Fair Use Policy ("Policy") applies to all Motion To File ("MTF") subscription plans that include unlimited or uncapped document generation, including the Business tier. It supplements, and is incorporated by reference into, our Terms and Conditions.

1. Intended use

Unlimited plans are designed to support the ordinary, good-faith document generation needs of a single law practitioner, business owner, or firm. They are intended for human-driven legal work product — drafting, revising, and finalizing motions, pleadings, and filings — not for automated bulk content production, dataset construction, model training, or resale.

2. Fair use threshold

"Unlimited" means no fixed monthly cap on documents generated through normal, attended use of the Service by an authorized user. Usage that materially exceeds typical patterns for similarly situated customers — or that imposes a disproportionate load on our infrastructure or AI model capacity — may be treated as outside the scope of fair use.

3. Prohibited usage

Without limiting the Acceptable Use provisions of the Terms, the following activities are prohibited on unlimited plans and constitute a material breach of these Terms:

• Automated bulk generation, scripted batch jobs, or scraping of Outputs.
• Programmatic access, reverse-engineered API calls, headless browser automation, or any form of API abuse against the Service.
• Sharing a single account across multiple users, teams, or organizations beyond the seat count purchased.
• Reselling, sublicensing, or redistributing Outputs as a standalone product or service.
• Using the Service to build, train, fine-tune, evaluate, or benchmark any competing AI model, dataset, or legal-drafting product.
• Any usage that degrades performance, availability, or cost stability of the Service for other customers.

4. Enforcement

Where MTF reasonably determines that an account has exceeded fair use or engaged in prohibited usage, we may, at our sole discretion and without prior notice:

• Apply rate limits, throttling, or temporary generation caps to the account.
• Require the customer to upgrade to a higher tier or a custom agreement appropriately sized to the actual usage.
• Suspend the account pending investigation.
• Terminate the account and any associated subscriptions, with or without refund as governed by our Refund and Liability Policy.
• Pursue any other remedy available under the Terms or applicable law.

5. Good-faith review

Before taking enforcement action against a legitimate customer whose usage appears to be in good faith, MTF will, where reasonably practicable, contact the account owner to discuss the usage pattern and identify an appropriate plan. Customers anticipating unusually high volumes are encouraged to contact us in advance at our contact page to arrange a custom agreement.

6. Changes to this Policy

We may update this Policy from time to time. Material changes will be notified by email or through the Service. Continued use of an unlimited plan after the effective date of an update constitutes acceptance of the revised Policy.
